Description: A lot of different parties claim an interest in PHI, whether it be health care organizations, patients, or even cyber threat actors.  Learn more about each of these parties’ interests and the legal implications that arise from them.

Session Description: PHI is valuable.  It is valuable to health care organizations and patients, but it also is also available to a variety of third parties, both with good and bad intentions for using the information.  Through this presentation attendees will learn:

  • What parties have interests in PHI and what purpose(s) underlie those interests?
  • What rights do individuals have with respect to their own PHI?
  • What can covered entities and business associates do with PHI in a data hungry world?
  • What can organizations do to prevent cyber threat actors from accessing PHI?
  • What are the potential consequences when PHI is compromised?

Speaker: Mark Swearingen has practiced in the area of health information privacy and security for over 20 years, with particular focus on HIPAA compliance, data breach response, government investigations, HIPAA audits and 42 C.F.R. Part 2. Mark has handled a substantial number of health care data breaches, including cases involving ransomware, email phishing, lost/stolen devices, insider threats and medical devices. He regularly guides clients through government investigations of privacy and security incidents and has successfully negotiated resolutions and settlements with both federal and state regulators. Mark also advises clients on issues relating to emerging technologies, such as telemedicine, medical apps and artificial intelligence. Mark understands the complexities of health care privacy and security as well as the various challenges that health care organizations face with these issues. He has worked with a broad spectrum of organizations, including health systems, hospitals, physician practices, health plans, governments, technology companies and business associates.
